These General Terms and Conditions apply to contracts for the rental of holiday apartments for accommodation as well as all other services and deliveries provided to the guest by NjoY Morocco. The services of NjoY Morocco are provided exclusively based on these General Terms and Conditions.
Subletting or re-letting the holiday apartment and its use for purposes other than residential require our prior written consent.
The guest’s terms and conditions shall only apply if these have been agreed in advance. Deviations from these terms and conditions are only effective if we have expressly confirmed this in writing.

This vacation rental contract is a legal agreement between NjoY Morocco (also referred to as the “owner”, “we”, “us” or “our”) and you, the tenants (also referred to as “guests” or “client”). The term “services” refers to all services provided by NjoY Morocco, including but not limited to receiving booking information through our booking and payment system, managing reservations and payments and responding to customer enquiries through our reservation system and managing content on third party channels through our Channel Manager.
1. Booking / Booking confirmation
This contract is entered into agreement as of the date when the tenants place their reservation online through our website, a booking platform, our contact form, via email or phone, and the reservation is reviewed and accepted by the owner. The owner will notify the tenants by email when their reservation is accepted. The tenant will receive a confirmation from the booking platform. Alternatively, our channel manager or the owner will notify the tenants by email when their reservation is accepted. Please inform us immediately if there are any discrepancies in the costs or details of your booking.
In the case of a group booking, the group leader or the person making the reservation must have the authority to sign on behalf of everyone in the group. The individual making the reservation will be responsible for the full cost of the rental
2. Terms of payment
If you’ve made a deposit with your booking, rather than paying the full amount, the balance of all dues to NjoY Morocco must be settled no later than upon check-in on your arrival date. If no deposit was paid, the full amount is due upon check-in. We reserve the right to retain credit card details as a guarantee and may charge any outstanding balance, including where payments are due upon arrival or in case of a no-show, where we have the authority to charge the full amount.
When you make your booking, the holiday price is typically fixed; however, we reserve the right to adjust prices due to changes in service charges or exchange rates. Once a booking is confirmed, discounts cannot be applied retrospectively.
We accept payment in cash, bank transfers, and via Wise/PayPal for accommodation. Arising bank transfer or currency exchange fees need to be paid by the client. For services such as surf classes, yoga classes, equipment rental, and excursions, cash payment is the only accepted method, except for rental car services, which can also be paid with a credit card.
When making electronic deposits, please ensure to include your booking number and/or surname in the transfer reference.
Please note: Your payment must reach us by the due date to avoid cancellation of bookings and/or services. Final payment is due upon arrival unless otherwise advised. After making any payments, please contact us to verify receipt.
3. Arrival and departure
On the day of arrival, the holiday apartment is available from 3pm. The guest will receive information about the handover of the keys at latest 2 days before arrival by e-mail or via booking platform.
On the day of departure, the apartment must be vacated by 12noon. If the guest wishes to leave late, this should be agreed with us in advance. A late departure without prior agreement will be charged.
If the guest does not show up by 11pm on the day of arrival, the contract will be deemed cancelled after 24 hours without notification to NjoY Morocco. NjoY Morocco may then freely dispose of the apartment. A (pro rata) refund of the rent due to early departure will not be made.
4. Holiday apartments
The holiday apartment will be handed over by us in an orderly and clean condition with a complete inventory. Should you notice any defects during your stay, the guest is obliged to inform NjoY Morocco immediately. The guest is liable for any damage caused by him/her to the rental property, or the inventory, e.g. broken crockery, damage to the floor or furniture. This also includes the cost of lost keys.
The inventory is to be treated with care and is only intended to remain in the holiday apartment. Moving furnishings, in particular beds, is prohibited. The guest is also liable for the fault of fellow travellers. Damage caused by force majeure is excluded from this. If the holiday apartment is used in breach of contract, such as subletting, overcrowding, disturbance of the peace, etc., the contract can be terminated without notice and the guest must leave the holiday apartment. The rent already paid remains with NjoY Morocco and a (pro rata) refund of the rent due to early departure will not be made.
5. Pets
The accommodation of pets of any kind in the holiday apartment is only permitted with the prior written consent of NjoY Morocco. If animals are accommodated without the prior consent of us, the latter may terminate the contract without notice and the guest must leave the holiday apartment. The rent already paid remains with NjoY Morocco and a (pro rata) refund of the rent due to early departure will not be made.
6. Holiday stay
The holiday apartment may only be used by the persons listed in the booking. All guests must provide their passport / ID card for registration upon check-in. A maximum of 4 person are allowed in the apartment (babies and small children sleeping in the bed of their parents are excluded). If the holiday apartment is used by more persons than agreed NjoY Morocco has the right to terminate the contract without notice. The rent already paid remains with NjoY Morocco and a (pro rata) refund of the rent due to early departure will not be made.
Subletting and transfer of the apartment to third parties is not permitted. The guest agrees to the general terms and conditions as well as the house rules of the holiday apartments. The declaration of consent is made with the payment.
In the event of violations of the general terms and conditions or the house rules, NjoY Morocco is entitled to terminate the tenancy immediately and without notice. There is no legal entitlement to repayment of the rent or compensation.
7. Cancellation Policy
In the event of cancellation, the guest is obliged to inform NjoY Morocco immediately and submit the cancellation in writing. The guest may be required to pay a portion of the agreed price as compensation. The amount of compensation depends on the time remaining until the day of arrival and is calculated as follows:
Cancellation over 2 days before arrival – loss of 0% of payment.
Cancellation less than 2 days before arrival – loss of 100% of payment.
No show (not present at the day of arrival) – loss of 100% of payment.
Njoy Morocco reserves the right to cancel your holiday under certain circumstances, with exceptions for force majeure situations. In such cases, we will either refund all amounts paid or offer an alternative holiday of a similar standard.
There are no refunds for early departure.
8. Cancellation by the owner
In the event of cancellation on our part, as a result of force majeure or other unforeseeable circumstances (such as accident or illness of the host) as well as other circumstances for which we are not responsible and which make fulfilment impossible, liability is limited to reimbursement of the costs. In the event of justified cancellation, the customer shall not be entitled to compensation – no liability shall be assumed for travel and hotel costs.
Cancellation by NjoY Morocco can be made after the start of the rental period without notice.
9. Liability of the owner
Under the terms of this agreement, NjoY Morocco, assumes limited liability in the following circumstances:
Liability for Rental Property: NjoY Morocco is liable for providing the rental property within the duty of care. However, liability for breakdowns or faults in water or electricity supply, as well as events due to force majeure (see below), is excluded.
Force Majeure and Unforeseeable Events: Njoy Morocco shall not be held responsible for any death, disability, injury, damage, liability, loss, cost, expense, delay, inconvenience, or loss of enjoyment resulting directly or indirectly from:
Force majeure events beyond our control, including but not limited to war, civil disturbance, terrorism, acts of government, weather conditions, natural disasters, and industrial action.
Inability to fulfil special requests related to age, medical conditions, physical ability, dietary requirements, allergic conditions, or accommodation preferences.
Negligence, delays, or cancellations by service providers such as airlines, tour operators, land operators, and transfer companies.
Failure to comply with laws, regulations, instructions, or itineraries provided by us, tour operators, or other authorities, or engaging in hazardous behaviour or activities exceeding personal abilities.
Reservation Changes and Notifications: Clients are responsible for verifying itinerary details and promptly notifying us of any errors or discrepancies. Failure to do so may result in assumptions of correctness. Corrections made after payment or beyond a reasonable time may incur fees.
Information Accuracy: NjoY Morocco does not guarantee the accuracy or completeness of information provided by employees, contractors, agents, or representatives.
Acknowledgement of Risk: Clients acknowledge that foreign travel entails hazards and personal risks. NjoY Morocco, its staff, and agents disclaim liability for any loss, damage, injury, expense, delay, or inconvenience arising from hazards or risks associated with travel.
Liability for Travel Arrangements and Service Providers: Njoy Morocco acts as an agent in arranging travel services (e.g. Marrakesh transfers not supplied by Njoy Morocco). We accept no liability for any injury, loss, damage, accident, delay, irregularity, or costs incurred by guests or third parties resulting from their use. Some service providers (e.g. transfer companies, tour guides) may have additional booking conditions. As agents for these providers, we do not take responsibility for any omissions, defaults, neglect, or inaccuracies in their information or statements. Some service providers may require additional booking forms for reservations to be completed.
10. Authorisation to use Internet access via Wifi
NjoY Morocco maintains Internet access via Wifi in its holiday apartments. It permits the guest to use the Wifi access to the internet for the duration of their stay in the holiday property. The tenant does not have the right to authorise third parties to use the Wifi.
NjoY Morocco does not guarantee the actual availability, suitability, or reliability of the internet access for any purpose. It is entitled at any time to allow other co-users to operate the Wifi in whole, in part or temporarily and to restrict or exclude the tenant’s access in whole, in part or temporarily if the connection is or has been used in breach of the law, insofar as NjoY Morocco must fear a claim as a result and cannot prevent this with normal and reasonable effort within a reasonable period of time. In particular, NjoY Morocco reserves the right to block access to certain sites or services via Wifi at any time and at its reasonable discretion (e.g. sites that glorify violence, pornographic or fee-based sites).
11. Access data
The Wifi is used by a secured access. The access data (login and password) may not be passed on to third parties under any circumstances. If the guest wishes to grant third parties access to the internet via Wifi, this is subject to our prior written consent and the acceptance of the provisions of this user agreement by the third party, documented by signature and full identity details. The guest undertakes to keep his/her access data secret. NjoY Morocco has the right to change access codes at any time.
12. Dangers of Wifi use, limitation of liability
The guest is advised that the Wifi only enables access to the internet, virus protection and firewall are not available. The data traffic generated using the Wifi is unencrypted. The data can therefore possibly be viewed by third parties. NjoY Morocco expressly points out that there is a risk that malware (e.g. viruses, Trojans, worms, etc.) can get onto the end device when using the Wifi. Use of the Wifi is at the guest’s own risk and peril. We accept no liability for damage to the tenant’s digital media caused by the use of internet access unless the damage was caused by us intentionally or through gross negligence.
13. House rules, responsibility
Clients are expected to behave in an orderly and acceptable manner. Njoy Morocco reserves the right to refuse further accommodation and terminate contractual obligations if a client’s behaviour threatens the condition of the accommodation, vehicles, or the enjoyment of other guests. The responsible party will be held liable for any resulting damages.
Compliance with House Rules: Guests are required to adhere to the house rules. Quiet hours are observed from 11 pm to 8 am. To minimize disturbance, TV and audio equipment must be set to room volume.
Marriage Certificate Requirement for Moroccan Couples: Moroccan couples are required to present a valid marriage certificate upon check-in.
Restriction on External Guests: External guests are prohibited from entering the apartment premises. Additionally, if a guest will join you at a later date and stay with you in the apartment, they must be registered upon arrival and provide a valid passport.
Window and Door Maintenance: During the rental period, guests must ensure that windows and doors are closed when leaving the holiday apartment.
Smoking Policy: Smoking is prohibited within the holiday apartment. Non-compliance may result in terminating the contract without notice and the guest must leave the holiday apartment. The rent already paid remains with NjoY Morocco and a (pro rata) refund of the rent due to early departure will not be made. Smoking is only permitted on balconies and terraces.
Parking Facilities: Free parking is provided for our guests directly in front of the house. For added security, the parking area is monitored by video surveillance. If parking space is limited, please inform us promptly, and we will assist you in finding alternative parking arrangements. Guests are kindly reminded to ensure that no vehicles obstruct the exit from our garage.
Decoration and Attachment Restrictions: Guests are not permitted to install or attach materials for decoration or similar in the holiday apartment. Any decorations or attachments installed by guests are done so at their own risk, and guests are liable for any resulting damage.
Right of Access: NjoY Morocco reserves the right of access to the holiday apartment at any time, especially in the event of imminent danger. When exercising this right, consideration will be given to the guest’s legitimate interests. Guests will be informed in advance about the exercise of this right unless it is unreasonable or impossible given the circumstances of the individual case.
14. Alterations to Your Holiday
While it’s uncommon, there may be occasions where minor alterations to your holiday are necessary. We reserve the right to make these changes at any time, and we will inform you of any such adjustments at the earliest opportunity.
15. Insurance
Booking a holiday with Njoy Morocco requires full travel insurance for all guests. Njoy Morocco bears no responsibility for any loss, theft, or damage to persons or property during their stay.
16. Health & Fitness
Bookings are accepted by NjoY Morocco on the condition that all persons travelling are physically and mentally fit and are able to cope reasonably with the demands of the holiday, without external help.
By booking an activity or excursion through us (NjoY Morocco, acting as an agent between the guest and the tour guide/third party), you acknowledge and accept the inherent risks of the holiday. These risks include navigating challenging climates and terrains (e.g., Atlas Mountains, Sahara Desert), as well as participating in activities such as quad biking and camel riding. Your participation in these tours signifies your understanding and acceptance of the associated personal risks, which may include injury, illness, property loss or damage, inconvenience, and discomfort.
17. Passport & Visa
Guests are responsible for carrying valid passports and obtaining appropriate visas.
Swiss or EU passport holders with passports valid for at least 6 months beyond the return date do not require a visa for tourist visits to Morocco. However, if you hold a passport from outside the European Union, USA, Canada, or Russia, we strongly advise checking with the nearest Moroccan Embassy for visa requirements.
Guests are responsible for ensuring they have all necessary travel and other documents. We regret that we cannot accept any liability if you are refused entry into the country due to your failure to carry the correct documentation. If failure to have any required documents results in fines, surcharges, or other financial penalties being imposed on us, you will be responsible for reimbursing us accordingly.
18. Dispute Resolution
Any disputes arising from these terms and conditions will be resolved through mediation or arbitration, governed by the laws of the court of Agadir.
19. Additional Information
We are not responsible for your travel to or from this point or for any expenses, including travel accommodation, subsistence, and loss of earnings, caused by a delayed return to your departure point, howsoever caused.
